The O category holds several very different cases: spouses and children of Thai nationals, dependants of a Non-Immigrant B holder, retirees who meet the age requirement, and those coming for medical treatment. Each has its own documents and its own financial criteria. Preparing for the wrong one is the most common reason applications fail.
It must be stressed that the O category does not confer the right to work. A holder who wishes to work still needs a work permit, except in the specific cases the law provides for.
We establish which case applies, then prepare to that case's criteria.
Who uses the O category
- Spouses of Thai nationals, who must show a properly registered marriage and meet a financial requirement.
- Parents and children of Thai nationals.
- Dependants of holders of other Non-Immigrant categories.
- Retirees meeting the age requirement, who must show funds held in a Thai bank account or a qualifying regular income.
- Those entering for medical treatment, and accompanying carers.
What applicants commonly get wrong
- Assuming marriage to a Thai national confers the right to stay automatically. It does not: an application with full documents is required at every extension.
- Assuming the O category permits work. It does not; a work permit is separate.
- The funds shown must have been in the account for the full period required before the application. Transferring them in days beforehand does not meet the criterion.
- Forgetting the re-entry permit before leaving Thailand, which ends the permission to stay and means starting again.
- Forgetting the ninety-day report, which is separate from the extension.
What we do
- Establish which case applies and what has to be shown.
- Prepare the documents and the certified translations each office requires.
- File extensions of stay and re-entry permits.
- Handle the ninety-day reporting.
- Act where an application is refused and where there is an overstay problem.
Financial criteria and required documents are administrative rules that change periodically and differ between immigration offices. Tell us your circumstances and the current criteria can be checked.
