Thai-Foreign Families

Families with a foreign spouse carry two extra layers: cross-border document legalisation, and immigration status.

What costs the most time here is rarely family law itself. It is that documents from each country must be legalised in stages before they can be used, and doing the stages out of order means sending them back to be redone — often weeks lost.

The other layer is that the foreign spouse's permission to stay is tied to family status in many cases. A change in one always affects the other, and both should be planned together from the start.

We handle both sides in one office: the family work, the translation and legalisation, and the immigration filings.

Registering a marriage

  • The foreign spouse needs an affirmation of freedom to marry from their own embassy, translated and legalised at the Department of Consular Affairs before the registration.
  • If previously married, evidence that the earlier marriage ended: the divorce registration or the former spouse's death certificate.
  • Registration can be done at any district office.
  • To have the marriage recognised in the foreign spouse's own country, the Thai marriage certificate must be legalised and reported there as well.

Prenuptial agreements

A prenuptial agreement can vary the statutory rules on marital property, but the requirements are strict: in writing, signed by both parties and witnesses, and recorded in the marriage register on the day of registration. Made afterwards, it has no effect.

This matters most where one party holds assets abroad or has children from an earlier marriage.

Land and property

A foreign national cannot own land as a general rule. Where a Thai spouse buys land during the marriage, the authorities require both to confirm in writing that the purchase money is the Thai spouse's personal property — which affects how the asset divides on any later divorce. Understand what that document does before signing it.

Condominium units can be owned by foreign nationals within the statutory quota, supported by evidence that the funds were brought in from abroad.

Divorce with a foreign spouse

  • A consent divorce registered in Thailand may also need to be legalised and reported in the foreign spouse's country, or that country will still treat the marriage as subsisting.
  • Whether a foreign divorce judgment has effect in Thailand is assessed case by case; it is not automatic.
  • A foreign spouse whose stay is based on the marriage is affected when the marriage ends, so plan ahead.
  • Custody of dual-national children should be settled clearly and early. Removal from Thailand without consent is extremely hard to undo.

Requirements differ by embassy and by country, and they change. This page is general guidance; tell us the spouse's nationality and where the documents will be used, and the current steps can be checked.
